Court Vacates $23 Million Default Judgment Against International Client

Swanson, Martin & Bell, LLP successfully moved the Circuit Court of Cook County to dismiss an international dispute that had previously resulted in entry of a $23 million default judgment against its client.

The plaintiff claimed that an international investment fund committed fraud and breached its contract with foreign investors. The plaintiff obtained a $23 million default judgment in August 2017.

In September 2017, Swanson, Martin & Bell, LLP attorneys Timothy S. McGovern and Emily J. Fitzgerald moved to dismiss the case and vacate the judgment, arguing that Illinois lacked personal jurisdiction over the firm’s client. The Court agreed. On March 1st, the Court dismissed the matter outright and vacated the $23 million judgment, holding that the court lacked personal jurisdiction.
